As worldwide litigation has become common, the cost of complex business disputes or regulatory investigations have increased especially since the majority of business information is now being stored electronically. One of the headaches for in house counsel and law firms is information that contains a foreign language. Competent document reviewers for a foreign language are not easily found and they are hired at a higher rate than regular e-discovery attorneys. Therefore, some companies may hire vendors that provide electronic translation data from foreign languages to English to cut overhead. However, nuances of the language get lost in translation when using electronic translation, since the language often depends on context for meaning. The danger of relying on electronic translation is that companies may be exposed to liabilities, if they miss privileged information-attorney client communications and work product- and potential trial exhibits. As a matter of fact, many business people often use subtle expression in their language while communicating among themselves.
